Terms of Service

These Terms of Service (hereby referred to as "Terms") govern the use of the mobile application "StoneLens" (hereby referred to as "Application") provided by Akira Kawata (freeweb) (hereby referred to as "Service Provider"). The Application is provided as a Free service and is intended for use "AS IS".
By downloading or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Application.

2. Definitions
- "Application" refers to the mobile application "StoneLens" for mobile devices.
- "Service" refers to all features provided through the Application, including AI mineral identification, collection management, and identification history storage.
- "User" refers to any person who downloads, installs, or uses the Application.
3. Changes to Terms
The Service Provider reserves the right to modify these Terms at any time without prior notice. Updated Terms will become effective upon publication on this page. Your continued use of the Application after any changes constitutes your acceptance of the revised Terms.
4. License Grant
The Service Provider grants you a non-exclusive, non-transferable, limited license to use the Application for personal, non-commercial purposes, subject to these Terms.
You may not:
- Reverse engineer, decompile, disassemble, or modify the Application;
- Copy, distribute, publish, sell, or lease any part of the Application;
- Use the Application to provide commercial services;
- Infringe upon any intellectual property rights contained in the Application.
5. Requirements for Use
To use the AI mineral identification feature of the Application, the following conditions apply:
- You must have a compatible mobile device;
- An internet connection is required;
- You must enter your own OpenAI API key in the Settings screen (for AI identification features).
You are responsible for obtaining, at your own cost and expense, the equipment, internet connectivity, and API key necessary to use the Application. The Service Provider assumes no responsibility for such preparations.
6. Prohibited Conduct
When using the Application, you shall not:
- Violate any applicable laws or regulations;
- Infringe upon the rights of the Service Provider or any third party (including intellectual property rights and privacy rights);
- Gain unauthorized access to the Application's servers or networks, or impose an unreasonable load on them;
- Interfere with the operation of the Application;
- Violate any provision of these Terms.
The Service Provider may, without prior notice, suspend the use of the Application by any user who violates this section.
7. AI Identification Feature Disclaimer
The AI identification feature sends images captured or selected by you to the OpenAI API and displays AI-generated analysis results. By using this feature, you acknowledge and agree to the following:
- Nature of Results: AI identification results are provided for informational purposes only and do not constitute a guarantee of accurate identification of minerals, rocks, or gemstones. Any decisions based on identification results are your sole responsibility.
- Image Transmission: Images you capture or select are transmitted to the OpenAI API for identification purposes. Transmitted images are handled in accordance with OpenAI's privacy policy and data usage policies.
- API Key Management: Your OpenAI API key entered in the Settings screen is stored exclusively in the device's local storage. You are solely responsible for the secure management of your API key and compliance with OpenAI's Terms of Service. The Service Provider assumes no liability for API key leakage, unauthorized use, or damages arising from OpenAI's usage limitations.
- API Usage Fees: Fees associated with the use of the OpenAI API are your responsibility under the terms of your direct agreement with OpenAI. The Service Provider does not charge any fees related to API usage.
8. Third-Party Services
The Application uses the following third-party services. The respective privacy policies and terms of service of each service apply:
- OpenAI API: AI mineral identification feature
- Google AdMob: Ad delivery
- Google Analytics for Firebase: Usage analytics

9. Intellectual Property
All content included in the Application (design, text, images, logos, icons, software code, etc.) is the property of the Service Provider or its rightful owners. The license granted under these Terms does not constitute a transfer of ownership or intellectual property rights in the Application.
10. Disclaimer of Warranties
10.1 The Application is provided "AS IS" without warranties of any kind. The Service Provider expressly disclaims all warranties, whether express or implied, including but not limited to the functionality, accuracy, completeness, usefulness, fitness for a particular purpose, and non-infringement of the Application.
10.2 The Service Provider assumes no responsibility for:
- Damages arising from the use or inability to use the Application;
- Damages arising from inaccuracies in AI identification results;
- Damages to your device, data, or software;
- Effects of changes, suspension, or termination of third-party services (OpenAI, Google, etc.);
- Effects of communication network failures;
- Updates, changes, or discontinuation of the Application.
11. Limitation of Liability
Except in cases of intentional or grossly negligent conduct by the Service Provider, the aggregate liability of the Service Provider for damages arising from the Service shall not exceed the total fees paid by the User for the Service during the three (3) months immediately preceding the event giving rise to the claim (or 1,000 yen if such amount is less than 1,000 yen).
The Service Provider shall not be liable for any indirect, special, incidental, consequential, lost profits, or punitive damages.
12. Termination
You may terminate your use of the Application at any time by uninstalling it from your device. Upon uninstallation, all identification history, collection data, and settings stored on the device will be deleted.
The Service Provider may immediately suspend or terminate your use of the Application, without prior notice, if you violate these Terms.
13. Privacy
For information about how the Application handles user data, please refer to our Privacy Policy. The collection and use of information referenced in these Terms are governed by the Privacy Policy.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Japan.
Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the Chiba District Court or the Tokyo District Court as the court of first instance.
15. Miscellaneous
15.1 Severability If any provision of these Terms is found to be invalid or unenforceable, the invalidity of such provision shall not affect the remaining provisions, which shall continue in full force and effect.
15.2 Apple Rights If you downloaded the Application through Apple Inc.'s App Store, the following applies: (a) You acknowledge that your license to use the Application may be subject to Apple Inc.'s App Store Terms of Service; (b) Any obligations or claims of the Service Provider under these Terms shall not be directed at Apple Inc.; (c) Apple Inc. assumes no warranty or support obligations regarding the Application.
15.3 Waiver The failure of the Service Provider to exercise any right under these Terms shall not constitute a waiver of such right or any other right.
